CARS FOR SALE
After reading the Parish
Council extracts in the June Reeve’s Tale the item cars ‘For Sale’ on the
A1067, I phoned both the Highways Department and Dereham Police regarding
the legality of this practice, of which I am guilty.
I was informed by both that,
as long as the vehicle was taxed and MOT’d and not causing an obstruction,
there would be no cause for concern, so long as you were a private seller,
Please assure other residents that should they wish to advertise a vehicle
for sale in this way, they will not be breaking the law.

The
Bawdeswell Parish Clerk has received this letter from Norfolk County Council
Highways Department:
Bawdeswell – Vehicles for
Sale on the Highway. (Usually refers to all Highway land, verges
etc., as I once found out to my cost. Ed.)
The Legal position is as
follows:-
The standing of vehicles
on the public highway unless reasonably incidental to the public’s right
to pass and re-pass or for some other lawful reason, is an obstruction
and an offence.
Such vehicles are a public
nuisance and a trespass on the highway.
The County Council has statutory
duties to assert and protect the rights of the public to the highway.
The Council has a common
law right to clear obstructions and to deal with trespasses to the highway.
This position is enforced for persistent offenders or where there is an
obvious obstruction but not normally in a ‘one off’ situation.
